Onyx Notary Experts is not a law firm and does not provide legal advice. Notaries are legally prohibited from:
Determining or recommending the type of notarization required
Explaining the legal meaning or consequences of documents
Assisting in the preparation or completion of documents
Clients must know which notarization is required before the appointment. If uncertain, you must contact the issuing or receiving party for instructions prior to notarization.
All documents must be fully completed before the notary appointment, with the exception of signatures.
Documents containing blank spaces, missing information, or incomplete sections will not be notarized.
Signatures must be executed in the presence of the notary.
Every signer and required witness must be physically present during notarization.
Each individual must present a valid, current government-issued photo ID.
When acceptable identification is unavailable, a signer may use two credible witnesses, provided they:
Personally know the signer
Present valid identification
Have no direct or indirect interest in the document
Are willing to swear or affirm the signer’s identity
Clients are responsible for arranging any required witnesses.
Witnesses must arrive on time with appropriate identification.
Employees of hospitals, nursing homes, or other facilities may be restricted by policy from serving as witnesses. Clients should provide their own witnesses in advance.
Notarization is prohibited when a signer has been legally declared mentally incapacitated and the notarization relates to rights removed by court order, including but not limited to real estate transactions, marriage, or voting.
Onyx Notary Experts reserves the right to decline service if the notary cannot reasonably determine that a signer is acting knowingly, willingly, and with full understanding.
In accordance with applicable law, documents must be read in full to a blind signer prior to notarization. Additional appointment time may be required and should be considered when scheduling.
If a signer does not read or speak English, a competent interpreter must be present to translate the document. The signer is responsible for providing the interpreter. Services may be refused if effective communication cannot be established.
Signers must be conscious, alert, and responsive at the time of notarization. Onyx Notary Experts will not proceed if the signer is sedated or otherwise unable to demonstrate awareness and willingness.
Onyx Notary Experts reserves the right to refuse or discontinue services when legal requirements are not met or when notarization would violate state law or ethical standards.
